Coal Harbour Massage Therapy Clinic WELLNESS CLUB™
Terms and Conditions
General
1. The Coal Harbour Massage Therapy Clinic WELLNESS CLUB Program (“WELLNESS CLUB” or the “Program”) is a customer rewards program and/ or Pre-Paid Card program offered by Coal Harbour Massage Therapy Clinic herein referred to as “CHMTC”. Members must be over the age of majority in their province of residence or have obtained the consent of their parent or legal guardian if under the age of majority to participate in this Program. Members of the Program collect WELLPOINTS ä REWARDS points through service and product purchases at the CHMTC location. The WELLNESS CLUB cards may also be Pre-Paid for use as a Gift Card for a third party or a personal Pre-Paid Card for service and product purchases at the CHMTC location.
2. The Program is for personal use only. Businesses, corporations, joint ventures, partnerships, groups or associations are not eligible.
3. The WELLNESS CLUB card is not a credit card.
4. To participate in the Program, a customer must become a member of the Program (a “Program Member” or “Member”) by enrolling at the CHMTC location. In the case of Gift Cards there will be no requirement to become a member of the program.
5. CHMTC will issue each Member a unique WELLNESS CLUB card (the “WELLNESS CLUB card” or “Card”). The Card will be linked to each Member’s account in order to collect WELLPOINTS on purchases of services and products from CHMTC. Should the member wish they able to load any Canadian dollar amount on the card and receive addition benefits as outlined in the “Collection Schedule”.
6. The annual WELLNESS CLUB membership fee is free
7. The WELLNESS CLUB card is the property of CHMTC and may be unilaterally revoked at anytime by CHMTC in its sole discretion, with or without notification.
8. WELLNESS CLUB is valid at the CHMTC location and on-line website only.
9. WELLNESS CLUB Member’s Point balances (“Point Balances”) are tracked centrally across all participating CHMTC locations.
10. Unauthorized reproduction of Card may lead to forfeiture of all collected WELLPOINTS and legal prosecution.
11. Members shall advise a CHMTC Customer Service Representative immediately of any address, phone or email changes.
12. CHMTC may, in its sole discretion, cancel, restrict, suspend, amend, extend or otherwise alter the Program, with or without notice to Members. Notice of changes may, at CHMTC’s sole discretion, be communicated to Members via clinic circulars and/or notices posted in-clinic, emails and online at www.thewellnessclub.ca. In the event CHMTC cancels the Program, Members will have 90 days from the effective date of the cancellation of the Program to redeem their existing Points.
Inactive Members
13. Should any WELLNESS CLUB account not earn any Points for 12 consecutive months, all accumulated Points and Pre-Loaded card balance may be forfeited, with or without notice, in CHMTC’s sole discretion.
14. Should any Member’s WELLNESS CLUB account be suspended, revoked or cancelled pursuant to these terms and conditions (at the sole discretion of CHMTC), such Member’s WELLPOINTS and Pre-Loaded card Balance will be reduced to zero and their membership in the WELLNESS CLUB Program will be cancelled.
Additional Members
15. WELLNESS CLUB Members may authorize additional members of their household (“Additional Members”) to collect and redeem points, or pre-load the card by providing the names of the Additional Members to a CHMTC Customer Service Representative at the CHMTC location. Each Additional Member will receive an individual Card and points will be awarded and accumulated independently.
16. Each Additional Member must also agree to be bound by these terms and conditions and will be held liable for non-compliance with CHMTC 24 hour cancellation fee policy.
Collection of WELLNESS CLUB Points and Card Pre-Load Benefits
17. To collect WELLPOINTS, a Member must present their WELLNESS CLUB card at the time of product or service purchase. Members who do not have their Card with them during the transaction must provide identification that is acceptable to the CHMTC customer service representatives in their sole discretion and will have up to thirty (30) days from the date of purchase to have the Points posted to their WELLNESS CLUB account upon presentation of their receipt and Member card to a CHMTC Customer Service Representative in-clinic.

19. CHMTC may change the Point Value at any time, with or without notice, in CHMTC’s sole discretion.
20. From time-to-time special promotions at participating CHMTC location (“Special Promotions”) may add Points to a Member’s Points Balance. Balances will be reflected within 2 business days on future transaction receipts.
21. Subject to any Special Promotions, only Items paid for at the time of sale are eligible to earn Points. For example, a Member presenting a coupon for a two-for-one product at the time of purchase will only be eligible to collect Points for the paid product Item.
22. Points collected during each transaction and total Point Balances will be shown on receipts issued at the time of sale. If a technical failure at the time of sale prevents printing of the Points balance on the receipt, the receipt on a future transaction will show all Points collected. Point balances can also be tracked on-line at www.thewellnessclub.ca .
23. Point and Pre-Load Balances appearing on-line will be deemed to reflect the correct Point and Pre-Load amount. The Member must address discrepancies to a CHMTC Customer Service Representative at the CHMTC within 90 days of the applicable service/purchase date.
24. All Points that were collected on an Item that is returned will be automatically deducted from the Member’s Point balance. No points will be collected for fees charged on missed or cancelled appointments as set out by CHMTC cancellation policy.
Rewards
25. Members may redeem Points collected through the Program for Rewards. Points are automatically converted to an available credit on the WELLNESS CLUB card according to the following “redemption schedule”.
26. Points available for redemption are calculated at the beginning of a sales transaction.
27. A Member’s Point Balance is reduced by the amount of redeemed Points. Remaining balance is carried forward.
28. Points will be forfeited on the Member’s account if a Product Reward is returned after purchase through the redemption of Points.
29. From time-to-time, CHMTC, in its sole discretion, may add products or services to the Redemption Schedule or modify the number of Points required for Rewards.
30. Points can be redeemed towards all products and services at CHMTC as set forward in the Redemption Schedule.
31. If the Reward amount as specified in dollars cannot be fully used on a transaction, the remaining value of the Reward will be carried forward.
32. WELLPOINTS and Pre-loaded Credit amounts have no cash value and are not exchangeable for cash. WELLPOINTS and Card Pre-Loads cannot be sold or purchased or otherwise transferred. WELLPOINTS and Card Pre-Loads are void if sold for cash or other consideration.
33. WELLPOINTS will only be converted to the reward credit at the stated redemption point amount. Partial or accrued amounts under 100 points have no value and the redemption reward amount is only converted once the 100 point level has been achieved.
34. CHMTC will not be liable or responsible in any manner for any tax consequences that may flow from any participation in the WELLNESS CLUB Program.
Lost or Stolen Cards
35. Members must notify CHMTC immediately if their Card is lost or stolen. A Member is responsible for all charges incurred through the use of the Card until its return to CHMTC or receipt by CHMTC of notice from the Member of the loss or theft of the Card. CHMTC is not liable for the redemption of Points or Preloaded Cash from a Card prior to such notice of loss or theft.
36. To obtain a replacement Card, a Member must present a piece of valid government-issued photo identification at the CHMTC location. CHMTC will immediately cancel the lost or stolen card and will transfer the Points and Pre-loaded Cash balance to the replacement Card.
37. Lost or stolen Gift Cards are the responsibility of the recipient and will not be replaced nor will credit for services or product be provided by CHMTC.
Equipment Usage
38. Members and/or Additional Members who damage equipment within CHMTC premises will have the cost of repair or replacement (“damage charge”) charged to the Member’s account.
39. Member acknowledges that the information provided by Member may be disclosed to a collection agency for the purpose of collecting any outstanding “damage charges”.
40. CHMTC reserves the right to change its service and product rates upon posting notices of any such changes at its CHMTC location or on its website www.thewellnessclub.ca . Members who do not accept such changes, must cancel their Membership by returning their Card in person. By continuing to purchase services and product following such a change, Members and any Additional Members shall be deemed to have accepted such changes.
Privacy
41. At CHMTC, the security and integrity of our customers’ personal information is important to us. CHMTC is committed to protecting our customers’ privacy, thus, will not sell or share our customers’ information with any parties outside of CHMTC. All customer information will be subject to the CHMTC privacy policy as amended from time to time in accordance with its terms. The current version of the CHMTC privacy policy may be viewed at www.thewellnessclub.ca .
42. At CHMTC, we collect customer information for one or more of the following purposes:
a. To set up and manage WELLNESS CLUB accounts, including accurately recording Points and up-to-date Point Balances;
b. To issue WELLPOINTS and administer Point redemptions;
c. To allow Members to be automatically entered into exclusive promotions and contests;
d. To allow Members to engage in special offers and rewards;
e. To communicate with Members via email;
f. To better understand Members’ interests and preferences and to recommend products and services that may be of interest to Members;
g. To provide a positive customer experience, and deliver, bill for, and collect payment for products and services;
h. To understand customer requirements and make information available regarding products and services offered by CHMTC and its agents, dealers and related companies; and
i. To meet legal and regulatory requirements.
Acceptance of Terms and Conditions
43. By joining the WELLNESS CLUB Program and using the WELLNESS CLUB Card, a Member or potential Member (i) certifies that he or she is over the age of majority in the province in which he or she resides (or has obtained the consent of his or her parent or guardian); (ii) certifies that the information provided to CHMTC for the purpose of completing this application is true and correct (iii) consents to CHMTC’s Privacy Policy as set out in these Terms and Conditions; and (iv) agrees to these terms and conditions as may be amended from time to time.
44. Members agree to indemnify and hold harmless CHMTC from and against all losses, damages, costs, charges and expenses which CHMTC may sustain, incur or be liable for or in consequence of any Member’s non-compliance with these Terms and Conditions.
44. Any claim, dispute or controversy (whether in contract or in tort, pursuant to statute or regulation, or otherwise, and whether pre-existing, present or future) arising out of or relating to these Terms and Conditions (a “Claim”) will be determined by arbitration to the exclusion of the courts. Arbitration will be conducted by one arbitrator pursuant to the laws and rules relating to commercial arbitration in the province in which the Member resides. You agree to waive any right you may have to commence or participate in any class action against CHMTC related to any Claim and, where applicable, you also agree to opt out of any class proceeding against CHMTC.
